1. Agreement to Terms
By downloading, installing, or using the Swimming Tools mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access or use the App.
2. About the Service
Swimming Tools is a mobile application developed and operated by Sports Stats Ltd, a company registered in England and Wales ("we," "us," or "our"). The App provides tools for swimming performance analysis, including:
- Pace calculations and split times
- Multi-lane stopwatch functionality
- Breathing pattern analysis
- Turn timing and efficiency analysis
- Stroke rate measurements
3. Subscription Services
3.1 Premium Features
The App offers premium features available through subscription purchases. Premium features include:
- Pace Calculator
- Multi-Lane Stopwatch
- Breath Timer
- Turn Timer
- Additional features as released
3.2 Payment and Billing
- All payments are processed through Apple's App Store
- Subscription prices are displayed in the App before purchase
- Subscriptions automatically renew unless cancelled at least 24 hours before the current period ends
- Payment will be charged to your Apple ID account at confirmation of purchase
- You can manage and cancel subscriptions through your Apple ID account settings
4. User Responsibilities
You agree to:
- Provide accurate information when using the App
- Use the App only for its intended purposes
- Not attempt to circumvent any technical measures or payment systems
- Not use the App in any way that could damage or impair its functionality
5. Intellectual Property
5.1 Ownership
The App, including all content, features, and functionality, is owned by Sports Stats Ltd and is protected by international copyright, trademark, and other intellectual property laws.
5.2 Limited License
We grant you a limited, non-exclusive, non-transferable license to use the App for your personal, non-commercial purposes.
6. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPORTS STATS LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.
8. Data Storage and Privacy
8.1 Local Storage
- Swimming performance data is stored locally on your device
- We do not collect or store personal performance data on external servers
8.2 Privacy Policy
Your use of the App is also governed by our Privacy Policy.
9. Modifications to the Service
We reserve the right to:
- Modify or discontinue any part of the App
- Change subscription fees upon notice
- Update these Terms at any time
10. Termination
We may terminate or suspend your access to the App immediately if you violate these Terms. Upon termination:
- Your subscription will be cancelled at the end of the current billing period
- Local data will remain on your device until you delete the App
11. Export Control
You may not use or export the App in violation of applicable export laws and regulations.
12. Governing Law
These Terms shall be governed by the laws of England and Wales, without regard to its conflict of law provisions.
