Terms of Use

These Terms of Use ("Terms") govern your use of the iOS application Airline Director (the "App"), published by Sports Stats Limited, a company registered in England and Wales ("we", "us", "our").

By downloading, installing or using the App you agree to these Terms. If you do not agree, do not use the App and delete it from your device.

The App is also subject to Apple's Licensed Application End User Licence Agreement ("Apple EULA"). Where these Terms and the Apple EULA conflict, the Apple EULA prevails to the extent of the conflict.

1. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use one copy of the App on Apple-branded devices that you own or control, for your own personal, non-commercial entertainment, in accordance with the App Store Terms of Service.

This is a licence, not a sale. We and our licensors retain all right, title and interest in the App.

2. What You May Not Do

You may not copy, distribute, rent, lease, lend, sell or sublicense the App; reverse engineer, decompile or disassemble the App, or attempt to derive its source code, except to the extent that applicable law expressly permits this despite this restriction; modify the App, or create derivative works based on it; circumvent, disable or interfere with any purchase, licensing or content-unlock mechanism in the App, including by modifying saved game files or device data to obtain paid content without payment; remove or obscure any copyright, trade mark or other proprietary notice; or use the App in any way that breaches applicable law.

3. In-App Purchases

The App is a paid download and additionally offers optional in-app purchases. These fall into two kinds: consumable purchases (for example, investment credits added to a saved game), which are applied to your saved game, used up when applied, and cannot be restored or transferred to another save or another device; and non-consumable purchases (for example, permanent content unlocks), which are tied to your Apple Account and can be restored using the Restore Purchases option in the App.

You should understand before purchasing that all purchases are processed by Apple — your contract for the purchase is with Apple, and Apple's terms and refund policy apply. We cannot issue refunds; refund requests must be made to Apple at reportaproblem.apple.com. Purchased items are virtual in-game items with no monetary value, cannot be exchanged for money, goods or services, and cannot be traded or transferred. Consumable purchases applied to a saved game are lost if you delete that saved game or delete the App — this is not a fault and is not grounds for a refund from us. Prices are set by us and displayed by the App Store in your local currency; we may change prices, and may add, alter or withdraw in-app purchase items in future versions. Purchases are for entertainment within the App only — they are not investments and confer no rights of any kind outside the App.

4. Saved Games

The App stores saved games locally on your device. We do not operate a save server and do not hold a backup of your progress.

Saved games may be lost or become unusable if you delete the App, reset or lose your device, or if a saved file is corrupted by a device fault or by editing outside the App. We may also, on rare occasions, need to change the save format in a way that makes older saves unreadable; we will say so in the release notes where this happens.

We are not liable for lost saved games or lost in-game progress, including any progress obtained through in-app purchases. If losing progress would matter to you, keep your device backed up.

5. The Simulation Is Fiction

Airline Director is a work of fiction and a game. Airports, aircraft types, market conditions, economic and regulatory behaviour, rival carriers and financial outcomes in the App are simplified, invented or dramatised for play.

Nothing in the App is aviation, commercial, accounting, investment or financial advice, and nothing in it should be relied on for any real-world decision. Any resemblance between an in-game carrier and a real airline is coincidental. Where real place names or aircraft designations appear, they are used descriptively and nominatively; no affiliation with, endorsement by or sponsorship from any airline, airport, aircraft manufacturer or authority is claimed or implied.

6. Updates and Availability

We may issue updates, and may change, suspend or discontinue the App or any of its features at any time. We are not obliged to maintain support for older versions of iOS or for older devices. We do not warrant that the App will be available uninterrupted or error-free.

7. Intellectual Property

The App, including its code, design, text, artwork, game systems and the name "Airline Director", is owned by Sports Stats Limited or its licensors and is protected by copyright and other intellectual property laws.

You may freely share screenshots and video of your own play, including on monetised channels, provided you do not present the App as your own work.

8. Disclaimer of Warranties

To the fullest extent permitted by law, the App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including any implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, accuracy or non-infringement.

Nothing in these Terms excludes or limits your statutory rights as a consumer, including your rights under the Consumer Rights Act 2015 in respect of digital content that is not of satisfactory quality, not fit for purpose or not as described.

9. Limitation of Liability

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded.

Subject to that, and to the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or for loss of profit, revenue, data, saved games or goodwill, however caused; and our total aggregate liability arising out of or in connection with the App and these Terms is limited to the greater of (a) the total amount you paid for the App and its in-app purchases in the twelve months before the claim arose, and (b) £20.

10. Termination

This licence terminates automatically if you breach these Terms. On termination you must stop using the App and delete it. Sections 5, 7, 8, 9 and 12 survive termination. Termination does not entitle you to a refund except as required by law or by Apple's refund policy.

11. Apple

Apple is not a party to these Terms and has no obligation to furnish any maintenance or support for the App. Apple is not responsible for any claim relating to the App, including product liability claims, claims that the App fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation. Any such claim is our responsibility, not Apple's. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute arising out of or in connection with them, except that if you are a consumer resident elsewhere in the United Kingdom or in the EEA, you may also bring proceedings in the courts of your country of residence, and you retain the benefit of any mandatory consumer protection law there.

13. General

If any provision of these Terms is held unenforceable, the remainder continues in force. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Apple EULA and our Privacy Policy, form the entire agreement between you and us in respect of the App.

We may amend these Terms. The current version will always be published at the location linked from the App's App Store listing, with the "Last updated" date changed. Material changes will be noted in the App's release notes.
