Agreement to Terms
By downloading, installing, accessing, or using TrainingMood – Rate Workouts ("the App," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
Description of Service
TrainingMood is a mobile application that allows users to:
- Rate their training sessions using a mood-based rating system
- Record session details, including names and notes
- View training history and statistics
- Track training progress over time using calendar and list views
The App is provided for personal, non-commercial use to help you track and understand your training patterns.
Eligibility
You must be at least 13 years old to use TrainingMood. By using the App, you represent and warrant that:
- You are at least 13 years of age
- You have the legal capacity to enter into these Terms
- You will use the App in accordance with these Terms and applicable laws
User Responsibilities
Acceptable Use
You agree to use TrainingMood only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the App for any illegal or unauthorized purpose
- Attempt to reverse engineer, decompile, or disassemble the App
- Interfere with or disrupt the App's functionality
- Use the App in any way that could damage, disable, or impair the App or any related services
Data Accuracy
You are responsible for the accuracy of any information you enter into the App. We are not responsible for any errors or omissions in the data you provide.
Intellectual Property
Our Rights
TrainingMood, including its original content, features, and functionality, is owned by us and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
Your Rights
You retain all rights to the data and content you create within the App. By using the App, you grant us a limited, non-exclusive license to use your data solely for the purpose of providing the App's functionality.
Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO:
- WARRANTIES OF MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY, RELIABILITY, OR COMPLETENESS OF DATA
We do not warrant that:
- The App will be uninterrupted or error-free
- Defects will be corrected
- The App is free of viruses or other harmful components
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR:
- ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
- DAMAGES RESULTING FROM YOUR USE OR INABILITY TO USE THE APP
This limitation applies regardless of the legal theory on which the claim is based, including contract, tort, negligence, strict liability, or otherwise.
Health and Fitness Disclaimer
IMPORTANT: TrainingMood is a mood tracking tool and is not intended to:
- Provide medical, health, or fitness advice
- Diagnose, treat, or prevent any health condition
- Replace professional medical or fitness guidance
The App is for informational and tracking purposes only. Always consult with qualified healthcare or fitness professionals before making decisions about your health, fitness, or training regimen.
You acknowledge that:
- Exercise and training activities carry inherent risks
- You are solely responsible for your health and safety during training
- We are not responsible for any injuries or health issues that may result from your training activities
- You should consult with healthcare professionals before beginning any new training program
Premium Subscription and Payments
Subscription Service
TrainingMood offers a Premium subscription service that provides access to additional features, including:
- Tag Management: Create, edit, and organize custom tags for your sessions
- Tag Sessions: Add tags to sessions for better organization
- Filter by Tags: Filter sessions and calendar by tags
- Mood Trends: View detailed charts showing your mood trends over 7 and 28 days
Subscription Terms
By purchasing a Premium subscription, you agree to the following:
- Subscriptions are billed on a yearly basis
- Payment will be charged to your Apple ID account at the confirmation of purchase
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase
Cancellation
You may cancel your subscription at any time through your Apple ID account settings. Cancellation will take effect at the end of the current billing period. You will continue to have access to Premium features until the end of your current subscription period.
Refunds
All purchases are processed through the Apple App Store. Refund requests must be submitted to Apple through their standard refund process. We do not process refunds directly. Apple's refund policy applies to all purchases made through the App Store.
Data and Privacy
Your use of TrainingMood is also governed by our Privacy Policy, which explains how we handle your data. Please review our Privacy Policy to understand our practices.
Key points:
- All data is stored locally on your device
- We do not collect, transmit, or share your personal data
- You are responsible for backing up your data if desired
- We are not responsible for data loss due to device failure, loss, or theft
App Store Terms
If you downloaded TrainingMood from the Apple App Store:
- Your use of the App is also subject to the Apple Media Services Terms and Conditions
- You acknowledge that Apple is not responsible for the App or its content
- Apple has no obligation to provide support or maintenance for the App
- All subscription purchases and payments are processed by Apple, and you agree to Apple's payment terms and conditions
- Apple is responsible for processing refunds in accordance with their refund policy
- In the event of any failure of the App, you may notify Apple, and Apple will refund the purchase price (if applicable)
Modifications to the App
We reserve the right to:
- Modify, suspend, or discontinue the App at any time
- Update the App with new features or improvements
- Fix bugs and address security issues
- Make changes that may affect functionality or user experience
We are not obligated to provide notice of such changes, though we will make reasonable efforts to notify users of significant changes when possible.
Termination
We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including if you breach these Terms.
You may stop using the App at any time by uninstalling it from your device. Upon uninstalling, all data stored locally on your device will be removed.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of TrainingMood and supersede all prior agreements and understandings.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by:
- Posting the updated Terms in the App
- Updating the "Last Updated" date
- Providing notice through the App Store update process when significant changes occur
Your continued use of the App after such modifications constitutes your acceptance of the updated Terms.
