Welcome to FastestQ. These Terms of Service ("Terms") govern your use of the FastestQ mobile application ("App") provided by Sports Stats Ltd, a company registered in England and Wales. By downloading, accessing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using FastestQ, you confirm that you:

• Are at least 13 years of age (or the minimum age required in your jurisdiction)
• Have the legal capacity to enter into a binding agreement
• Agree to comply with all applicable laws and regulations
• Accept these Terms in their entirety

2. Description of Service

FastestQ is a mobile application designed for coaches and athletes to:

• Track competition times and results
• Calculate qualifying cutoffs based on progression rules
• Manually enter competitor times
• Extract times from printed result sheets using AI-powered image scanning (subscription feature)
• Export event and timing data

3. User Accounts and Registration

You may be required to create an account to access certain features. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

4. Subscriptions and Payments

4.1 Subscription Plans

FastestQ offers the following subscription options:

• Weekly Subscription: Provides 50 image scans per week
• Annual Subscription: Provides unlimited image scans

4.2 Billing and Renewal

• Subscriptions are purchased through Apple's In-App Purchase system
• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your Apple ID Account Settings

4.3 Free Trial

If a free trial is offered, you will be charged the subscription fee when the trial period ends unless you cancel before the trial expires.

4.4 Refunds

Refund requests are handled by Apple according to their refund policy. We do not have access to or control over Apple's refund process. To request a refund, please contact Apple Support directly.

5. Acceptable Use

You agree NOT to:

• Use the App for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Infringe upon the intellectual property rights of others
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to our systems
• Reverse engineer, decompile, or disassemble the App
• Use automated systems or bots to access the App
• Resell or redistribute the App or its features
• Use the App to harass, abuse, or harm others

6. Intellectual Property Rights

All content, features, and functionality of FastestQ, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of Sports Stats Ltd and are protected by copyright, trademark, and other intellectual property laws.

7. User Content

7.1 Your Data

You retain ownership of all data you input into the App, including event information, competitor names, times, and images. By using the App, you grant us a limited license to process this data solely to provide the services described.

7.2 Image Scanning

When you use the AI-powered image scanning feature:

• Images are processed through OpenAI's Vision API
• Images are used solely for extracting timing data
• We do not permanently store uploaded images on our servers
• You are responsible for ensuring you have the right to upload and process any images

8. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

9. Third-Party Services

The App integrates with third-party services including:

• Apple In-App Purchase: For subscription management and payments
• OpenAI Vision API: For image processing and time extraction

Your use of these third-party services is subject to their respective terms and conditions.

10. Disclaimers and Limitation of Liability

10.2 Accuracy of Results

While we strive for accuracy, we do not guarantee that:

• The AI-powered time extraction will be 100% accurate
• Qualifying calculations will be error-free
• The App will be uninterrupted or error-free

You are responsible for verifying all times and results before using them for official purposes.

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPORTS STATS LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the App
• Any unauthorized access to or use of our servers
• Any interruption or cessation of transmission to or from the App
• Any bugs, viruses, or other harmful code
• Any errors or omissions in content or data

11. Indemnification

You agree to indemnify, defend, and hold harmless Sports Stats Ltd, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the App, or your violation of these Terms.

12. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent or illegal activity
• Extended periods of inactivity

Upon termination, your right to use the App will immediately cease. You may delete your account at any time through the App settings.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms in the App
• Updating the "Last Updated" date
• Sending an in-app notification or email (if applicable)

Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

14.2 Jurisdiction

You agree that any dispute arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sports Stats Ltd regarding the use of the App and supersede any prior agreements.
