These terms are an agreement between you and Sports Stats Limited ("we", "us"), a company registered in England and Wales and the developer of Airport Director (the "app"). By downloading or using the app you accept them. If you do not accept them, do not use the app.
Apple's standard Licensed Application End User License Agreement, available at apple.com/legal/internet-services/itunes/dev/stdeula/, also applies to the app. Where these terms and Apple's standard EULA differ, these terms govern, except on the points Apple's EULA reserves for itself.
1. Your Licence
We grant you a personal, non-exclusive, non-transferable licence to install and use Airport Director on Apple-branded devices that you own or control, as permitted by the App Store Usage Rules in your Apple Media Services Terms and Conditions. You may use it for your own entertainment. The licence lasts until it is terminated under section 10.
2. What You May Not Do
You may not copy, sell, rent, lease, sublicense or redistribute the app; reverse engineer, decompile or disassemble the app, or attempt to derive its source code, except where that restriction is prohibited by law; modify the app, or create derivative works from it; remove or obscure any copyright or other proprietary notices; or use the app in any way that breaks applicable law.
3. Ownership
The app, including its code, artwork, text, sounds, airline and airport names, game design and balance data, is owned by us and protected by copyright and other intellectual property laws. You are licensed to use it, not sold it. All rights not expressly granted are reserved.
Every airline, aircraft operator, airport, city and company name in the game is fictional. Any resemblance to a real carrier or business is coincidental. The app is not affiliated with, endorsed by or sponsored by any real airline, airport or aviation authority.
4. Open-Source Components
The app includes third-party software used under permissive open-source licences. The full licence texts are shown inside the app under Office › More › Licences. Those components remain the property of their authors and are governed by their own licences, not by these terms.
5. Your Saved Games
Your saved airports live on your device and belong to you. We have no copy of them and no way to recover them.
Save files can be lost if you delete the app, reset your device, or if a save file is damaged. We are not able to restore lost progress. The app will refuse to open a save file it cannot read rather than overwrite it, but this is not a guarantee against loss. If your progress matters to you, keep your iPhone backed up.
A future update may change the save format. We try to keep old saves working, but we cannot promise that every future version will read every older save.
6. No Purchases or Subscriptions
Airport Director contains no in-app purchases, no subscriptions, no advertising and no virtual currency that can be bought with real money. In-game cash has no monetary value, cannot be exchanged for anything outside the game, and may be changed or reset by an update.
7. Age Rating and Suitability
The app is rated 4+ and is intended for general audiences. It includes no chat, no user-generated content, no links to external websites and no social features. If you are under the age of majority where you live, you should have a parent or guardian read these terms with you.
8. No Warranty
The app is provided "as is" and "as available", without warranty of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy or non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that defects will be corrected.
Nothing here limits any statutory consumer rights that cannot be limited by agreement, including rights under the Consumer Rights Act 2015 and the consumer laws of the United Kingdom, the European Union, Australia and other jurisdictions that provide them.
9. Limitation of Liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, saved progress, profits or goodwill, arising out of your use of or inability to use the app.
Where liability cannot be excluded, our total liability to you is limited to the amount you paid for the app, or £20, whichever is greater.
We do not exclude or limit liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.
10. Termination
This licence ends automatically if you break these terms. It also ends when you delete the app from your devices. On termination you must stop using the app and delete all copies of it. Sections 3, 8, 9 and 13 survive termination.
11. Updates and Changes
We may release updates that change, add or remove features, including game content and balance. We may stop supporting the app or withdraw it from the App Store at any time. We are not required to provide updates or support.
We may revise these terms. The revised version applies from the date shown at the top of this page, and will be published wherever you found this one. Continuing to use the app after that date means you accept the revised terms.
12. Apple
Apple is not a party to these terms and has no obligation to provide any maintenance or support for the app. Apple is not responsible for any claim relating to the app, including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims under consumer protection or similar legislation. Any such claim is our responsibility, subject to these terms. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
You confirm that you are not located in a country subject to a United States Government embargo, or designated as a "terrorist supporting" country, and that you are not on any United States Government list of prohibited or restricted parties.
13. Governing Law
These terms are governed by the laws of England and Wales, without regard to conflict of law rules. If you are a consumer, you keep the benefit of any mandatory protections under the law of the country where you live, and you may bring proceedings in your local courts.
If any provision of these terms is held unenforceable, the rest stays in force.
14. Privacy
How the app handles data is described in the Privacy Policy, which forms part of these terms. In short: the app collects nothing, sends nothing, and keeps your saves on your device.
